This page provides information on local search, maps and character assessments.

Local land charges

Here you will find information about Northumberland County Council local land charges search. Local land charges searches are broken down into three parts:

1. The LLC1 (required)

If you are planning to buy or lease a property you will need to know whether there are any issues of concern, such as plans for a new road at the bottom of your garden or outstanding notices requiring you to remedy an earlier wrongdoing.

In this context the word "charge" means any outstanding financial claim, restriction, decision or information which may affect a particular property or parcel of land. These include charges for such services as roads, restrictions such as tree preservation orders and conditions imposed on planning permissions, conservation areas, legal agreements and listed buildings.

We, by law, must keep a local land charges register. The register records relevant information on every property/parcel of land within the county. It is updated daily and contains information on planning permissions, highway status/proposals, conservation area designation, tree preservation orders, enforcement notices, improvement grants, management orders, and financial charges.

2. The Con29R (required)

The Con29R deals with issues such as road schemes, planning history, building regulations and various notices which affect the property.

3. The Con29O (optional)

The optional Con29O gives additional information that a purchaser may be interested in such as pipelines and environmental notices.

Personal searches

Here you will find information on how to apply for a personal search and ask for component data.

You can make an appointment to make a personal search at the relevant local land charge office.

Please note, a personal search is not the same thing as component data. A personal search is only a viewing of the local land charges register.

Make an appointment for a personal search

Appointments are available between 10am and noon or 2pm and 4pm at the relevant local land charge office. You will need to make an appointment at least two working days in advance.

When calling for an appointment, we will ask you for the following information:

  • name and or/company
  • address of property
  • up-to-date location plan so we can identify the relevant parcel of land or property. The contact details for each area office can be found further doen this page.

The authority reserves the right to limit the number of searches carried out at each appointment (maximum five).

Please note:

  • Appointments will be kept open for 20 minutes after which a new appointment will have to be made. This is to ensure staff coverage and to minimise disruption to the 'official' search process.
  • Although the registers below are open for public inspection, that does not mean staff are under a legal obligation to supply supplementary or additional advice.
  • Our staff have been advised not to give gratuitous information because of the legal implications. You should, therefore, be aware you will be required to retrieve your information from the records provided.

Fees for a personal search

There is no charge for a personal search.

It must be stressed however, a personal searcher should be prepared to carry out a search and inspection of local authority records without assistance from local authority staff.

A personal searcher or any member of the public is entitled to inspect other public registers.

Accessing CON29R and land registry information

Land Registry information

Land Registry is the government department created in 1862 to register the ownership of land and property in England and Wales.

Component data

You can ask to receive component data from the county council.

How to request component data

Check which area office your property falls under here then email the following information to the relevant office:

  • company name
  • property address (a postcode must be submitted)
  • list of questions from the Con29R which you want answered
  • a suitable plan of the respective property (please make sure this is attached)

The email should also contain the following statement - "I agree to pay the relevant fee for this information at the time when I arrive to carry out my personal search of the local land charges register."

Example of a request: Dear Sir or Madam The Personal Search Company Property Name: Allerburn House, Denwick Lane, Alnwick, NE66 1YY I would like to request the following component data: 1.1F, G and H 3.7A, C and F 3.9N

Please note, if you only wish to get component data and do not wish to conduct a personal search of the local land charges you must post the relevant fee as a cheque made payable to Northumberland County Council to the relevant office with the questions you wish to be answered and a return address as well as the details listed in the email as appropriate.

Receiving your data

Once you have booked and paid for the component data and the responses have been collated from the relevant departments, the completed data will be sent to either your return address or relevant email address.

Fees and costs

Landowner statements

Commons & dedicated highways landowner statements - section 15A(1) of Commons Act 2006 & section 31(6) of Highways Act 1980.

On 1 October 2013 regulations came into effect providing for the deposit of statements by landowners, which would bring to an end any period of recreational use 'as of right' over the land to which the statement relates.

They also provide that the commons registration authority must establish and maintain a register of such applications containing certain requirements prescribed by the regulations.

The regulations also amend the form and procedure for depositing statements and declarations under section 31(6) of the Highways Act.

Here you will find details on how to make an application, fees that may apply and what happens once we receive your application.

Making an application

An application to deposit a statement under section 15A(1) or a statement or declaration under Section 31(6) must comply with the regulations.

Please note, the statement of truth in the application form places on the applicant the onus of getting facts correct. If the statement or map(s) in question contain a material error, then it could invalidate the application.

Fees

The application form must be accompanied by the prescribed fee. This is currently £277.50 for each statement under section 31(6), for each declaration under section 31(6) of the Highways Act 1980 and for each statement under section 15A(1) of the Commons Act 2006.

This fee will cover all aspects of the processing of the application save for any fees involved in the placing of site notices associated with statements under section 15A(1) of the Commons Act 2006. These fees will be variable depending upon the location of the land in question. There is no longer a requirement for site notices where an application is made solely under section 31(6) of the Highways Act 1980.

Applicants are advised to contact Alex Bell on 01670 624133 to ascertain the correct fees for site notices.

In the case of statements under section 15A(1) of the Commons Act, applicants must then send the completed application form and fees to the Commons Registration Authority, Legal Services Unit, County Hall, Morpeth, Northumberland, NE61 2EF.

In the case of statements/declarations under section 31(6) of the Highways Act, applicants must then send the completed application form to the Infrastructure Records Team, County Hall, Morpeth, Northumberland, NE61 2EF. Applicants will be invoiced following the receipt of their application.

Combined section 15A(1) and section 31(6) applications must be sent to Infrastructure Records Team, County Hall, Morpeth, Northumberland, NE61 2EF

Cheques must be made payable to "Northumberland County Council"

Note: If an application under section 15A(1) relates to more than one parcel of land, a separate processing fee of £100.00 will be charged for each parcel. Additional fees may also be charged for the placing of site notices on multiple parcels of land.

Acknowledgement

Once the registration authority/infrastructure records team is satisfied the application has been duly made, an acknowledgement will be sent to the applicant(s).

Serving notice

A notice in accordance with Form CA17 will be published on our website and will be posted at or near one obvious place of entry to the land.

Recording statement in register

The registration authority will keep a paper and electronic register of landowner statements under section 15A(1) of the Commons Act 2006.

The electronic register is currently being updated and will be available shortly.

The infrastructure records team will keep a paper and electronic register of landowner statements and declarations under section 31(6) of the Highway Act 1980.

Notice of application

Upon receipt of an application and the correct fee, the registration authority will place a notice at or near one obvious place of entry to the land. This notice will also be posted on this page under the parish in which the land falls.

N.B. From December 2016 onwards, it no longer became necesary to erect site notices for applications made in relation to just section 31(6) of the Highways Act 1980

Common land & village green - corrective applications

Corrective applications - section 19 (2)(a) and paragraphs 6 to 9 of the Commons Act 2006.

On 15 December 2015 regulations came into effect providing for applications to be made to the commons registration authority (CRA) to amend the registers of common land and town or village green in certain circumstances:

  • To correct a mistake made by the CRA in making or amending an entry in the registers of common land or town or village green (section 19 (2) (a)).
  • To remove buildings/land that were wrongly registered either as common land or town and village green (schedule 2 paragraphs 6 to 9)

DEFRA have issued updated guidance on making applications which fall within the regulations. This can be downloaded from DEFRA's website by clicking here.

Application process

Applications must be made on the statutory forms, copies of which can be found on the DEFRA website by clicking here.

If an application is being made under schedule 2, the application form must be accompanied by the prescribed fee of £1,000.

Applicants must then send the completed application form and fees to the Commons Registration Authority, Legal Services Unit, Corporate Resources Directorate, County Hall, Morpeth, Northumberland, NE61 2EF

Note: If after an application has been received, validated and publicised, it is clear the application will not be straightforward. For example, if written representations have been received in response which require more detailed consideration by way of inquiry, further fees may be payable based upon a costs recovery basis. Similarly, if the application is referred by the registration authority to the Planning Inspectorate for determination, a fee will be payable by the applicant to the Planning Inspectorate.

Acknowledgement

Once the registration authority is satisfied the application has been duly made, an acknowledgement will be sent to the applicant(s). The registration authority may also direct an applicant to provide any further information or documents necessary to enable the application to be determined.

Publicising the application

Notices of the application will then be published by, among other means, the county council's website.

There is provision for representations to be made in certain circumstances and applicants are advised to read the regulations and any guidance from DEFRA in this regard.

Determining the application

Depending upon the nature of the application, applications may be determined by either the registration authority or the Planning Inspectorate.

Applicants should note that the process is not likely to be quick. In common with applications for registration of town or village greens, applications are likely to take months or even over a year to conclude.

If an application is successful, the relevant register will be amended.
